Switzerland took a path almost no one else did. The Money Gaming Act, approved by referendum and in force since 2019, allows online casino licences only to companies that already hold a Swiss land-based casino concession. No standalone online operator can enter, foreign or domestic.

Enforcement is technical rather than merely legal: the Federal Gaming Board maintains a blocklist and Swiss internet providers are required to block access to unlicensed gambling sites. Payment restrictions reinforce it.

The result is one of the most genuinely closed online gambling markets in Europe. The sites a Swiss player can reach are, by design, largely the licensed ones.

Tax exemption is a real benefit here

Winnings from Swiss-licensed online casinos are exempt from income tax up to a high statutory threshold — an incentive built into the Act specifically to move players from offshore sites onto licensed ones.

Winnings from unlicensed foreign operators do not get that treatment and can be taxable, on top of being harder to receive at all given the payment restrictions.

Thresholds and treatment differ between casino and lottery winnings, and cantonal practice varies. This is one of the few markets where tax should genuinely influence where you play, and one where professional advice is worth having.

Player protection under the Act

Swiss licensees operate a shared exclusion list: a ban imposed by one casino applies across Swiss casinos, land-based and online, rather than at a single operator.

Licensees must also monitor play and act on indicators of problem gambling. These are conditions of the concession rather than a voluntary code.
